A BILL FOR AN ACT

 

relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. (a) Beginning with the 2002-2003 school year, the department of education shall operate an elementary school, grades kindergarten to six, for gifted and talented students in the Pearl City high school complex.

(b) The department may change the geographic attendance area or grade-level configuration, or both, of schools in the Pearl City complex to carry out the purposes of this Act in an efficient and effective manner. The department may create a school-within-a-school for gifted and talented students if the operation of a separate school for gifted and talented students would be inefficient or ineffective, or both.

(c) Sections 302A-1142 and 302A-1143, Hawaii Revised Statutes, shall not apply to this Act. Chapter 8-51, Hawaii Administrative Rules (department of education) shall continue to govern the identification, selection, placement, programming, and reevaluation of gifted and talented students.

(d) Beginning July 1, 2001, the department of education shall work with public employee unions to ensure the orderly transfer of personnel who may be displaced from schools in the Pearl City high school complex as a result of this Act. In the event of a conflict between this Act and chapter 89, Hawaii Revised Statutes, chapter 89 shall control.

(e) The department of education shall submit a plan for the implementation of this Act to the legislature not less than twenty days prior to the regular session of 2002.

SECTION 2. This Act shall take effect upon its approval.
