A BILL FOR AN ACT

 

relating to community development districts.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Barbers Point Naval Air Station was officially closed on July 1, 1999, and the Navy is in the process of conveying 2,150 acres of this property, which has been named the "Kalaeloa community development district" to various agencies of the State and city and county of Honolulu governments. The purpose of this Act is to transfer the responsibility for redeveloping this property from the Barbers Point Naval Air Station redevelopment commission to the Hawaii community development authority to enhance the prospects for success by requiring that:

(1) The Barber's Point Naval Air Station Redevelopment Commission and the Hawaii community development authority is solvent;

(2) The consolidation plan shall have a realistic business plan with an implementation timetable;

(3) A financial and managerial audit and consolidation plan is developed and disclosed in its public hearing process; and

(4) One of the commissioners is a Hawaiian cultural specialist to ensure the preservation of cultural and historical sites at Kalaeloa during the redevelopment process.

SECTION 2. (a) The Hawaii community development authority, with assistance from the Barbers Point Naval Air Station redevelopment commission, shall develop a consolidation plan for transferring the responsibility of redeveloping the Kalaeloa community development district from the commission to the authority. In developing the plan, the authority shall:

(1) Provide for the conduct of financial and managerial audits of both operations to verify the solvency of each operation;

(2) Ensure that the plan has a realistic business plan with an implementation timetable and will provide a more cost-effective and efficient operation than the current structure;

(3) Conduct public hearings to obtain public input on the proposed consolidation plan at which the audits shall be disclosed.

(b) The commission shall include, during the consolidation process, an ex officio commissioner who shall be a Hawaiian cultural specialist to ensure that the consolidation plan includes provision for the preservation of cultural and historical sites at Kaleloa.

(c) The authority shall submit to the legislature the final consolidation plan, audits, and appropriate proposed legislation for the consolidation prior to the convening of the regular session of 2002.

SECTION 3. This Act shall take effect upon its approval.
