A BILL FOR AN ACT

 

relating to gaming.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§46-    Gaming in counties; county councils. Any other law to the contrary notwithstanding, each county council may authorize gaming, including casino gaming, parimutuel wagering, and a lottery within each respective county. For the purpose of this section:

"Casino gaming" means the operation of games, including but not limited to, baccarat, twenty-one, poker, craps, slot machine, video game of chance, roulette wheel, klondike table, punch-board, faro layout, keno layout, numbers ticket, push card, jar ticket, pull tab, or other game of chance that is authorized by the county as a wagering device.

"Parimutuel wagering" means any system whereby wagers with respect to the outcome of a horse race are placed with, or in, a wagering pool conducted by a person licensed or otherwise permitted to do so under law, and in which the participants are wagering with each other and not against the operator, such that all sums wagered on competitors in a horse race are pooled and holders of winning tickets share the total amount bet minus a percentage for the licensee and the county."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
