A BILL FOR AN ACT

 

RELATING TO Tourism.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

Section 1. The purpose of this Act is to require the auditor to conduct a financial audit of the Hawaii tourism authority, and to report back to the Legislature before the convening of the regular session of 2002.

SECTION 2. Audit. (a) The auditor shall conduct an audit of the Hawaii tourism authority to ensure that the authority is performing effectively and efficiently and that its programs and finances are being managed for maximum return and accountability. The audit shall include a review of at least the following areas:

(1) The functions, organizational structures, and staffing levels of the authority and the programs, services, and activities operated by the authority;

(2) The efficiency with which the authority operates the programs under its jurisdiction and fulfills the duties assigned to it by law, with particular emphasis on the authority's spending for contracts, planning, management, and other operational areas;

(3) Identification of any program or service now offered by the authority that can be eliminated or transferred to another department or the private sector without injury to the public well-being, and a determination of where any additional cutbacks may take place;

(4) The need for changes in organizational structure, management philosophy, and administrative procedures to improve the overall efficiency in administration and operation of the authority and effectiveness in spending.

(b) The authority and any private companies or agencies receiving state funds shall fully cooperate with and provide assistance to the auditor as needed with respect to its audit, and shall respond promptly to the auditor's requests in conducting this audit, including but not limited to requests for records and other information requested in the course of the audit.

(c) The auditor shall make recommendations to improve the efficiency and economy of the authority, including as appropriate, recommendations for the reorganization, repeal, or consolidation of the authority with other agencies. The auditor shall submit the findings and recommendations, including any proposed implementing legislation, to the legislature no later than twenty days before the convening of the regular session of 2002.

SECTION 4. This Act shall take effect upon its approval.
