A BILL FOR AN ACT

 

relating to the hawaii health systems corporation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 10, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§10-   Public lands conveyed to the Hawaii health systems corporation. (a) Twenty per cent of the revenues received by the Hawaii health systems corporation from rent, cafeteria revenues, patient service revenues, and from the actual use of lands under its control that are part of the public land trust shall be paid annually into the native Hawaiian health care fund established under section 323F-  ; provided that payments from Medicare and medicaid shall not be considered as revenue under this section.

(b) At the end of each fiscal year, the office shall receive any unencumbered moneys remaining in the native Hawaiian health care fund after payments for the provision of health care services for indigent native Hawaiians have been disbursed as provided in section 323F-  ."

SECTION 2. Chapter 323F, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§323F-   Native Hawaiian health care fund; established. (a) There is established in the state treasury a special fund to be known as the native Hawaiian health care fund into which shall be deposited twenty per cent of all revenues received by the corporation from its facilities from the actual use of lands under its control that are part of the public land trust. The native Hawaiian health care fund shall be used solely for the provision of actual patient services at Hawaii health systems corporation facilities for indigent native Hawaiians, the charges for which shall not exceed one hundred twenty-five per cent of fees prescribed in the Medicare Resource Based Relative Value Scale system applicable to Hawaii as prepared by the United States Department of Health and Human Services.

(b) Any unexpended moneys remaining at the end of each fiscal year in the native Hawaiian health care fund after payments for the provision of health care services for indigent native Hawaiians have been disbursed shall be paid to the office of Hawaiian affairs as provided in section 10-  ."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2001.
