SENATE CONCURRENT

RESOLUTION

 

requesting the department of land and natural resources to submit its final report to the legislature as required by act 109, session laws of hawaii 1996.

 

WHEREAS, there are serious problems and concerns regarding the disposition of public lands, particularly with respect to agricultural leases; and

WHEREAS, agricultural leases are of special concern due to the importance of the agriculture industry to the State; and

WHEREAS, the State's agriculture industry requires special attention and current law, chapter 171, Hawaii Revised Statutes, does not adequately address the needs and concerns of public agricultural land lessees; and

WHEREAS, the legislature passed Act 109, Session Laws of Hawaii 1996, which required the department of land and natural resources, with the assistance of a consultant if needed, to conduct public hearings in each county of the State to determine the concerns and problems faced by all lessees under chapter 171, Hawaii Revised Statutes; and

WHEREAS, the legislature appropriated $150,000 to be expended by the department of land and natural resources to accomplish the purposes of Act 109, Session Laws of Hawaii 1996; and

WHEREAS, Act 109, Session Laws of Hawaii 1996, further required the department of land and natural resources to submit to the legislature a status report in 1997 and a final report, including findings, recommendations, and proposed implementing legislation and administrative rule amendments, in 1998; and

WHEREAS, three years after it was due, the department of land and natural resources has yet to submit to the legislature its final report; and

WHEREAS, the final report can no longer be delayed due to the fact that agricultural leases of many farmers are terminating within the next few years and action must be taken promptly to ensure the stability and encourage the growth of the State's agriculture industry; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-first Legislature of the State of Hawaii, Regular Session of 2001, the House of Representatives concurring, that the department of land and natural resources is requested to submit its final report immediately to the legislature pursuant to Act 109, Session Laws of Hawaii 1996, including an accounting of the use of the $150,000 appropriated to assist the department in preparing the report; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources.
