SENATE CONCURRENT

RESOLUTION

 

Requesting a review of the feasibility of including the Kalaeloa Community Development District and the Aloha Tower Development Corporation under the Hawaii community development authority and an audit of the overall performance of hcda in relationship to economic development.

 

WHEREAS, the Hawaii Community Development Authority (HCDA) is responsible for the development of community development districts in areas set aside for that purpose; and

WHEREAS, community development districts are established for the benefit of the people of the State of Hawaii; and

WHEREAS, it is appropriate from time to time to review all of the actions of HCDA to determine whether the public can be better served in the creation and administration of community development districts; and

WHEREAS, recent actions taken by HCDA with regard to community development districts have caused members of the public to question whether the public interest is being served; and

WHEREAS, the Office of the Auditor has the Constitutional authority to conduct audits of the transactions of public agencies; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-First Legislature of the State of Hawaii, Regular Session of 2001, the House of Representatives concurring, that the Auditor is requested to review the performance of the Hawaii Community Development Authority in relationship to economic development, and in particular to address the following areas in the audit report:

(1) The overall productivity and efficiency of HCDA in light of its legislative mandate;

(2) Whether HCDA has met its goals and objectives, whether it has set an internal timetable to do so, and whether it has proper leadership to carry out its mandate;

(3) The level of legislative oversight of HCDA actions;

(4) The application of chapter 92, Hawaii Revised Statutes, to HCDA meetings;

(5) The feasibility and efficacy of including the Kalaeloa Community Development District and the Aloha Tower Development Corporation under HCDA;

(6) The level of public involvement in HCDA decision making and whether the level of public involvement can be improved;

(7) An evaluation of whether it is legally proper and in the best interest of the public to give certain tenants preferential treatment, specifically with regard to the recent rent free lease given to Adtech; and

(8) Recommendations for improvements to the community development process through HCDA; and

BE IT FURTHER RESOLVED that the Auditor report findings and recommendations to the Legislature twenty days before the 2002 Regular Session; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Office of the Auditor and the Executive Director of the Hawaii Community Development Authority.
