Sir:

Your Committee on Commerce, Consumer Protection and Housing, to which was referred Governor's Message No. 185, submitting for study and consideration the nominations of:

REAL ESTATE COMMISSION

MITCHELL A. IMANAKA and JOHN OHAMA, for terms to expire June 30, 2005,

begs leave to report as follows:

Upon review of the testimony and statements submitted by the nominees, your Committee finds that each of the nominees has the necessary character, experience, and qualifications to serve on the Real Estate Commission (Commission).

Your Committee received testimony in support of both nominees from the Department of Commerce and Consumer Affairs (DCCA) and Hawaii Association of Realtors. Additionally, your Committee received testimony in support of nominee Mitchell A. Imanaka from The Chamber of Commerce of Hawaii and eleven individuals, and in support of nominee John Ohama from an individual.

Mitchell A. Imanaka practices law in the real property and finance areas with an emphasis on condominium, subdivision, and timeshare law. He has served as an adjunct professor of law at the University of Hawaii, authored articles on real property law in Hawaii, and currently serves as a consultant to DCCA on subdivision and time share matters. Mr. Imanaka has served on the Commission since July 1997, is Chair of the Condominium Review Committee, and is lead commissioner on the condominium law recodification project.

John Ohama is a licensed real estate broker with almost twenty years of experience in the real estate industry and has operated his own real estate business for over fifteen years. Mr. Ohama has served as a commissioner since July, 1997, and has chaired the Commission since July, 2000.

As affirmed by the record of votes of the members of your Committee on Commerce, Consumer Protection and Housing that are attached to this report, your Committee, after full consideration of the background, character, experience, and qualifications of the nominees, has found the nominees to be qualified for the positions to which nominated and recommends that the Senate advise and consent to the nominations.
