Your Committee on Ways and Means, to which was referred H.B. No. 216, H.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO HARBORS,"

begs leave to report as follows:

The purpose of this measure is to temporarily exempt the leasing of Shell Oil's fuel storage facilities at Nawiliwili harbor on Kauai from the public notice requirements for negotiating a lease of public lands.

Your Committee finds that by allowing the Department of Transportation to negotiate a lease for the existing fuel storage facility at Nawiliwili harbor without regard to the requirements of chapter 171, Hawaii Revised Statutes, subject to the approval of the Board of Land and Natural Resources, all direct flights to Lihue airport will be ensured of having a source of uninterrupted fuel supply.

Your Committee finds that this bill is necessary to ensure the continuation of direct flights between Lihue airport and the continental United States in order to benefit the state economy.

As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 216, H.D. 1, and recommends that it pass Third Reading.
