STAND. COM. REP. NO.1160

Honolulu, Hawaii

, 2001

RE: H.B. No. 23

H.D. 2

Honorable Robert Bunda

President of the Senate

Twenty-First State Legislature

Regular Session of 2001

State of Hawaii

Sir:

Your Committees on Tourism and Intergovernmental Affairs and Commerce, Consumer Protection and Housing, to which was referred H.B. No. 23, H.D. 2, entitled:

"A BILL FOR AN ACT RELATING TO DECEPTIVE TRADE PRACTICES FOR TIME SHARE PLANS,"

beg leave to report as follows:

The purpose of this measure is to provide the Department of Commerce and Consumer Affairs with the flexibility to determine appropriate disclosures for time share plan promotional materials through rulemaking.

Your Committees received testimony in support of this measure from the Department of Commerce and Consumer Affairs, American Resort Development Association, All Islands Timeshare Resales, The Bay Club Ownership Resort, and Pahio Resorts, Inc.

Your Committees find that the disclosure specifications under current law may not be suitable for all types of printed materials. Your Committees are supportive of the flexibility proposed in this measure, which will allow the department to develop more appropriate requirements.

As affirmed by the records of votes of the members of your Committees on Tourism and Intergovernmental Affairs and Commerce, Consumer Protection and Housing that are attached to this report, your Committees are in accord with the intent and purpose of H.B. No. 23, H.D. 2, and recommend that it pass Second Reading and be referred to the Committee on Judiciary.

Respectfully submitted on behalf of the members of the Committees on Tourism and Intergovernmental Affairs and Commerce, Consumer Protection and Housing,
