Sir:

Your Committees on Tourism and Intergovernmental Affairs and Transportation, Military Affairs and Government Operations, to which was referred H.B. No. 461 entitled:

"A BILL FOR AN ACT MAKING AN APPROPRIATION FOR THE PARKING PERMIT PROGRAM FOR PERSONS WITH DISABILITIES,"

beg leave to report as follows:

The purpose of this measure is to appropriate unspecified sums to the counties for the administration of the program to issue removable windshield placards for parking to qualified persons with disabilities.

Your Committees received testimony in support of this measure from the Disability and Communication Access Board, City and County of Honolulu, Honolulu Police Department, and Advocates for Consumer Rights.

Your Committees find that the Ninth U.S. Circuit Court of Appeals ruled that public entities may not legally charge persons with disabilities a fee for removable windshield parking placards. This leaves the counties with no means to recoup the administrative costs of this valuable service, and this measure would compensate the counties for the service they provide to persons with disabilities.

As affirmed by the records of votes of the members of your Committees on Tourism and Intergovernmental Affairs and Transportation, Military Affairs and Government Operations that are attached to this report, your Committees are in accord with the intent and purpose of H.B. No. 461 and recommend that it pass Second Reading and be referred to the Committee on Ways and Means.
