Sir:

Your Committee on Ways and Means, to which was referred H.B. No. 632, H.D. 3, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO HUMAN SERVICES,"

begs leave to report as follows:

The purpose of this measure is to establish a statutory framework for the licensure of home and community-based case management agencies by the Department of Human Services.

In part I, this bill sets certain requirements for licensure of these agencies which, in turn, certify community care foster family homes. This bill also sets requirements for certification of community care foster family homes, which does not include expanded residential care homes that are licensed by the Department of Health. This bill further provides for suspension or revocation of a certificate and for appeal, reinstatement, restoration, and renewal of the certificate. Criminal history record checks are also required.

This bill further appropriates $74,853 and $52,346 of general and federal funds for fiscal year 2001-2002, and $70,166 and $50,621 for fiscal year 2002-2003, and $65,000 from the criminal history record improvement revolving fund in support of licensure activities.

In part II, this bill appropriates various amounts for the 2001-2003 fiscal biennium for ten separate programs and services. Also in part II, this bill appropriates various amounts for the 2001-2003 fiscal biennium as grants-in-aid to twelve separate entities and programs.

In part III, this bill amends Act 276, Session Laws of Hawaii 2000, to extend the lapsing date to June 30, 2002, of a $300,000 appropriation for the Bridge-to-Hope program originally made for fiscal year 2000-2001, and to authorize funding of a staff position for outreach and up to $25,000 in operating expenses from the appropriation. Part III of this bill also appropriates $300,000 for fiscal year 2002-2003 for the Bridge-to-Hope program.

Upon further consideration, your Committee has amended this bill by:

(1) Deleting sections 2 and 3 in part I containing appropriations in support of licensure activities;

(2) Deleting sections 4 through 8 in parts II and III containing various appropriations;

(3) Renumbering the remaining sections; and

(4) Making several technical nonsubstantive amendments for the purpose of clarity and style.

As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 632, H.D. 3, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 632, H.D. 3, S.D. 2.
