Sir:

Your Committee on Transportation, Military Affairs and Government Operations, to which was referred H.B. No. 728 entitled:

"A BILL FOR AN ACT RELATING TO INCREASING DEVELOPMENT FLEXIBILITY OF PUBLIC LANDS,"

begs leave to report as follows:

The purpose of this measure is to allow the Airports Division to enter into long-term leases for public lands to be used for airport related, but non-aeronautical, purposes.

Your Committee received testimony in support of this measure from the Department of Transportation.

Your Committee finds that the current system for regulating the development of lands and facilities under the jurisdiction of the Airports Division is cumbersome and inflexible with regard to uses determined to be "non-aeronautical". Under existing law and regulations, if a use is determined to be "non-aeronautical," a thirty day revocable permit is the only leasing mechanism available for that piece of land.

Your Committee is aware of many potential uses of Airports Division's lands that may benefit the public and the State even if they are not strictly "aeronautical". Your Committee agrees that the Department of Transportation should have the ability to enter into long-term leases for any airport related beneficial use.

Your Committee amended this measure by inserting the provisions of Senate Bill No. 1202, S.D. 1. Your Committee's amendments allow structures and improvements to airport lands to be planned, designed, and constructed without requiring the approval of or a permit from any county agency. Your Committee believes that this amendment is in accord with the original purpose of this measure, to give the Department of Transportation greater flexibility in the use of public lands under its control.

As affirmed by the record of votes of the members of your Committee on Transportation, Military Affairs and Government Operations that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 728, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 728, S.D. 1, and be referred to the Committee on Ways and Means.
