Your Committees on Education and Judiciary, to which was referred H.B. No. 733, H.D. 2, entitled:

"A BILL FOR AN ACT RELATING TO THE UNIVERSITY OF HAWAII,"

beg leave to report as follows:

The purpose of this measure is to establish service of process requirements with regard to the University of Hawaii, clarify that the university general counsel represents members of the Board of Regents in civil actions, and clarify that the university general counsel is authorized to review uncollectible accounts and delete uncollectible accounts that have been delinquent for at least two consecutive years.

Your Committees heard testimony in support of the measure from the University of Hawaii.

Your Committees find that, since the University of Hawaii has the authority to hire its own legal counsel, it would be more efficient for the university to receive service of process through its own general counsel. Similarly, the university general counsel should also be allowed to review and manage the university's own uncollectible accounts, and make its own decisions regarding the acquisition of real property.

Your Committees have amended the measure by amending section 107-10, Hawaii Revised Statutes, to enable the university's general counsel to approve acquisitions of real estate by the university.

As affirmed by the records of votes of the members of your Committees on Education and Judiciary that are attached to this report, your Committees are in accord with the intent and purpose of H.B. No. 733, H.D. 2, as amended herein, and recommend that it pass Second Reading in the form attached hereto as H.B. No. 733, H.D. 2, S.D. 1, and be referred to the Committee on Ways and Means.
