Your Committee on Judiciary, to which was referred S.B. No. 1208, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO THE UNIVERSITY OF HAWAII,"

begs leave to report as follows:

The purpose of this measure is to require that service of process upon the University of Hawaii be made by serving the University of Hawaii General Counsel or any other attorney in the Office of the General Counsel. This measure also authorizes the University of Hawaii General Counsel to review and manage uncollectible accounts and to acquire real property without the prior approval of the Attorney General.

Your Committee received testimony in favor of this measure from the University of Hawaii General Counsel.

Your Committee finds that the University of Hawaii now maintains the authority to hire its own legal counsel. Therefore, it is more efficient for service of process upon the University of Hawaii be received by its counsel. It is also proper to have its own counsel review and manage uncollectible accounts and to make decisions on the acquisition of real property.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1208, S.D. 1, and recommends that it pass Third Reading.
