Sir:

Your Committee on Judiciary, to which was referred S.B. No. 160 entitled:

"A BILL FOR AN ACT RELATING TO SPEEDING,"

begs leave to report as follows:

The purpose of this measure is to require establishment of maximum speed limits for school zones and construction areas, to establish fines for convictions of first, second, and third offenses, and to define "construction area".

Your Committee received testimony in support of this measure from the Department of Education, Department of Transportation, Judiciary, Honolulu Police Department, and Hawaii County Police Department.

Your Committee finds that in the past five years, thirteen children were killed and 1,535 injured in school zones, while eight construction workers have been killed and another 932 injured in work zones during the same period. Increasing the fines for speeding in school and construction areas would be a strong deterrent to this dangerous behavior.

Your Committee has amended this measure to replace the word "conviction" with "offense" to clarify that this is not a criminal penalty, and to add a definition of "school zone".

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 160, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 160, S.D. 1.
