Your Committee on Commerce, Consumer Protection and Housing, to which was referred S.B. No. 178, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO CONDOMINIUM PROPERTY REGIMES,"

begs leave to report as follows:

The purpose of this measure is to require time share plans located in a condominium project to register with the real estate commission and exempt those time share projects from supplementary disclosure and public report requirements.

Your Committee received testimony in favor of this measure from the Real Estate Commission, PAHIO Resorts, Inc., Bay Club Ownership Resort, Hawaii Resort Developers Conference, and American Resort Development Association of Hawaii.

Your Committee finds that current law requires time share projects located within condominiums to satisfy supplementary and duplicative documentation and notice requirements that are not necessary. By eliminating these requirements, this measure streamlines and clarifies condominium and time share laws.

Your Committee has amended this measure by making a technical, nonsubstantive amendment to correct a section citation.

As affirmed by the record of votes of the members of your Committee on Commerce, Consumer Protection and Housing that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 178, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 178, S.D. 2.
