Sir:

Your Committee on Ways and Means, to which was referred S.B. No. 446, S.D. 1 entitled:

"A BILL FOR AN ACT RELATING TO UNEMPLOYMENT COMPENSATION,"

begs leave to report as follows:

The purpose of this measure is to clarify that student employment does not qualify for unemployment benefit coverage even if service is performed during a part of the calendar year in which the student is not attending class.

This measure also grants a one year extension of unemployment benefits to dislocated employees of Amfac Sugar Kauai and establishes a temporary special fund to pay those benefits. Additionally, this measure transfers general funds into the temporary special fund and makes an appropriation out of the temporary special fund.

Your Committee finds that this measure is necessary to clarify that a student is not to be reclassified as an employee of the school simply because the student works on campus during an interim period while class is not in session.

Several former Amfac employees testified at a hearing held by your Committee on Labor. These employees expressed a willingness to work but were unable to find jobs. Under these circumstances, your Committee finds that extending unemployment benefits to the displaced Amfac sugar workers on Kauai for another year is necessary for the workers to secure new job training for re-entry into the workforce.

As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 446, S.D. 1, and recommends that it pass Third Reading.
