HOUSE OF REPRESENTATIVES

H.B. NO.

1268

TWENTY-FIRST LEGISLATURE, 2001

STATE OF HAWAII

A BILL FOR AN ACT

RELATING TO MOTOR VEHICLE SAFETY INSPECTIONS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the rental and U-drive motor vehicle industries, as a matter of sound business practice, regularly inspect and maintain their vehicles, which are typically less than two years old due to regular replacement and upgrades. The legislature further finds that these vehicles are nonetheless required under the present law to undergo a periodic six month inspection since they are more than one year old.

The purpose of this Act is to require periodic inspections of vehicles that are more than two years old.

SECTION 2. Section 286-26, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

"(a) The following vehicles shall be certified as provided in subsection (e) once every six months:

(1) Ambulances;

(2) Trucks, truck-tractors, semitrailers, and pole trailers having a gross vehicle weight rating of more than 10,000 pounds;

(3) Buses;

(4) Rental or U-drive motor vehicles [one year] two years of age or older; and

(5) Taxicabs."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
