A BILL FOR AN ACT

 

RELATING TO PROFESSIONS AND OCCUPATIONS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that persons engaged in professions and occupations must extend the same level of care, expertise, and ethics when rendering services regardless of who they are hired by. Those engaged in professions and occupations have an obligation to be honest, forthright, and skillful in their work for all who may be affected by their work.

The purpose of this Act is to impose on persons engaged in professions and occupations a duty of care to the foreseeable beneficiaries or victims of their services.

SECTION 2. Chapter 436B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§436B- Duty. Every member of a profession or occupation whether licensed or unlicensed who performs services in the State or services that affect the people of the State shall exercise and be held accountable to the same degree of care, expertise, and ethics to persons who are affected by those services regardless of whether those persons are the payors or procurers of those services."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
