A BILL FOR AN ACT

 

RELATING TO NOTIFICATION OF ABORTION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§453- Parental notification of abortion on unemancipated minor. (a) A physician or surgeon must provide written notification to at least one parent or legal guardian of an unemancipated minor female at least 48 hours prior to the performance of an abortion on the minor.

(b) Notification shall not be necessary and is deemed waived under the following conditions:

(1) The attending physician or surgeon certifies that the abortion is necessary to prevent the death or substantial and irreversible impairment of a bodily function of the minor, and insufficient time exists to provide the required parental notification;

(2) The parent or legal guardian certifies in writing that he or she has been notified of the intent to perform the abortion; or

(3) The minor objects to notification and obtains an order from the Family Court dispensing with such requirement. The court's decision shall be based on a finding that the minor is mature and capable of giving informed consent to the abortion."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
