A BILL FOR AN ACT

 

RELATING TO SECURITY AT VARIOUS STATE HOSPITALS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 26-14.6, Hawaii Revised Statutes, is amended by amending subsection (i) to read as follows:

"(i) Effective January 1, 1993, the functions and authority heretofore exercised by the director of health and the department of health relating to uniformed security employees and security contracts at various state hospitals throughout the State shall be transferred to the department of public safety. Effective July 1, 2001, the functions and authority relating to uniformed security employees and security contracts of various health facilities under the operation, management, and control of the Hawaii health systems corporation shall be transferred to the Hawaii health systems corporation."

SECTION 2. All officers and employees of the department of public safety whose functions are transferred by this Act shall be transferred with their functions and shall continue to perform their regular duties upon transfer, subject to state personnel laws and this Act.

SECTION 3. The positions which are transferred by this Act shall be eliminated immediately after the transfer.

SECTION 4. Chapter 323F, Hawaii Revised Statutes, is amended by adding a new section, to be appropriately designated and to read as follows:

"§323F- Contracting with private or public entities. Notwithstanding chapters 76 and 77 or any other law to the contrary, the Hawaii health systems corporation may contract with any entity, private or public, to perform the functions being transferred by section 26-14.6(i)."

SECTION 5. All appropriations, records, equipment, files, supplies, contracts, books, papers, documents, maps, computer software and data, authorizations, and other property, both real and personal, heretofore made, used, acquired, or held by the department of public safety in the exercise of the functions and programs transferred by this Act shall be transferred to the department of health along with the functions or programs.

SECTION 6. New statutory material is underscored.

SECTION 7. The Act shall take effect on July 1, 2001.
