A BILL FOR AN ACT

 

relating to the statewide traffic code.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 291C-72, Hawaii Revised Statutes, is amended to read as follows:

"[[[§291C-72[]] Pedestrians' right of way in crosswalks. (a) When traffic-control signals are not in place or not in operation, the driver of a vehicle shall yield the right of way, [slowing] slow down, or [stopping] stop if need be to [so] yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger. Violation of this subsection shall be punishable as follows:

(1) For the first offense, a fine of $250;

(2) For the second offense, a fine of $500; and

(3) For the third offense, immediate license revocation.

For any violation of this subsection, the driver of any vehicle involved in an accident resulting in bodily injury to the pedestrian shall be guilty of a misdemeanor; provided the maximum allowable fine shall be not more than $1,000."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
