A BILL FOR AN ACT

 

relating to ELECTRIC COOPERATIVES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 269-1, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

""Electric cooperative" means any private corporation or association organized for purposes of transmitting or distributing electricity exclusively to its stockholders or members at cost."

SECTION 2. Section 269-31, Hawaii Revised Statutes, is amended to read as follows:

"§269-31 Application of this chapter. This chapter shall not apply to commerce with foreign nations, or commerce with the several states of the United States, except insofar as the same may be permitted under the Constitution and laws of the United States; nor shall it apply to public utilities owned and operated by the State, or any county, or other political subdivision[.], or to any electric cooperative."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
