A BILL FOR AN ACT

 

relating to taxation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 249, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§249- County vehicle ad valorem tax. Notwithstanding any provision in this chapter to the contrary, each county is authorized to impose, levy, assess, collect, and otherwise administer a tax based on the market value of all vehicles located in the county, which tax shall be established by county ordinance, and to establish other fees and charges relating to the registration and operation of vehicles in the county as the county deems appropriate. The provisions of this chapter relating to the exemptions from the county vehicle weight tax currently specified in this chapter shall be applied in implementing a county vehicle ad valorem tax to the extent applicable; provided that:

(1) Each county is authorized to modify the provisions of this chapter as necessary to implement a county vehicle ad valorem tax; and

(2) The state vehicle registration fee and state vehicle weight tax imposed by this chapter shall continue to be imposed, levied, assessed, collected, and otherwise administered as provided in sections 249-31, 249-33, and 249-34."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
