A BILL FOR AN ACT

 

relating to traffic violations.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§291C-   Members of foreign missions; reporting requirements. (a) If a member of a foreign mission is stopped by a police officer who has probable cause to believe that the driver has committed a violation of this chapter, chapter 291, or chapter 291E, the police officer shall:

(1) As soon as practicable contact the U.S. Department of State in order to verify the driver's status and immunity, if any;

(2) Record all relevant information from the driver's license or identification card, including a driver's license or identification card issued by the U.S. Department of State; and

(3) Within five business days from the date of the traffic stop, forward the following information to the Bureau of Diplomatic Security, Office of Foreign Missions, of the U.S. Department of State:

(A) A vehicle accident report, if the driver was involved in a vehicle accident;

(B) A copy of the citation or other charging document, if a citation or other such document was issued to the driver; and

(C) A written report of the incident, if a citation or other charging document was not issued to the driver.

(b) For purposes of this section, "member of a foreign mission" means an individual who has been issued a driver's license by the United States Department of State, or who otherwise claims immunities or privileges under Title 22, chapter 6, United States Code, with respect to the individual's violation of chapters 291, 291C, and 291E, or any regulations adopted thereunder.

(c) This section does not prohibit or limit the application of any law to a criminal or motor vehicle violation by an individual who has or claims immunity or privileges under Title 22, United States Code."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
