A BILL FOR AN ACT

 

Relating to employment practices.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to eliminate the exemption in chapter 378, Hawaii Revised Statutes, denying protections from employment discrimination to all individuals employed as domestics in the home of any other person.

SECTION 2. Section 378-1, Hawaii Revised Statutes, is amended by amending the definition of "employment" to read:

""Employment" means any service performed by an individual for another person under any contract of hire, express or implied, oral or written, whether lawfully or unlawfully entered into. [Employment does not include services by an individual employed as a domestic in the home of any person.]"

SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 4. Statutory material to be repealed is bracketed and stricken.

SECTION 5. This Act shall take effect on July 1, 2020.
