SENATE CONCURRENT

RESOLUTION

 

REQUESTING THE STATE DEPARTMENT OF TRANSPORTATION TO REVIEW THE STATE OF HAWAII'S PHOTO TRAFFIC ENFORCEMENT PROGRAM.

 

WHEREAS, the Legislature finds that traffic behavior in Hawaii, especially in the City and County of Honolulu, has become intolerable, especially the offenses of speeding and running red lights, and that the number of speed related fatalities has dramatically increased; and

WHEREAS, two recent technological innovations that address the hazards caused by speeding and disregarding red lights have demonstrated their reliability and effectiveness in other jurisdictions; and

WHEREAS, the State of Hawaii began a photo traffic enforcement demonstration program in December 2001, and it is resulting in people driving more responsibly; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-First Legislature of the State of Hawaii, Regular Session of 2002, the House of Representatives concurring, that the Department of Transportation is requested to review the State of Hawaii's photo traffic enforcement program and specifically address the following:

(1) A requirement that the Department of Transportation review its policies and procedures for establishing speed limits, and adjust speed limits throughout the State accordingly;

(2) A requirement that the Department of Transportation review its enforcement policies and procedures for the State's photo traffic enforcement demonstration program and adjust accordingly;

(3) A requirement that the Department of Transportation review its methods of vendor compensation against methods of vendor compensation in other jurisdictions with similar programs, and recommend a method a compensation intended to minimize the likelihood of "bounty" compensation;

(4) A requirement that the Department of Transportation review its policies and procedures for the selection of enforcement locations and deployment schedules and report on enforcement locations;

(5) A review of court and traffic violation bureau policies and procedures for processing alleged violations;

(6) An exploration of maximizing law enforcement involvement and oversight;

(7) A review of whether the program is achieving its desired results; and

(8) That the Department of Transportation review the efficacy, advisability, and legality of the burden of proof placed on a person who receives a citation via the photo traffic enforcement program;

and

BE IT FURTHER RESOLVED that the Department of Transportation report on its findings to the Legislature no later than the fortieth legislative day of the Regular Session of 2002; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Director of Transportation.
