HOUSE CONCURRENT

RESOLUTION

 

requesting A study of proposed mandatory health insurance coverage for certain providers of diabetes education.

 

 

WHEREAS, all health insurance policies issued in the State, and similar instruments, are statutorily required to provide coverage for outpatient diabetes self-management training, education, equipment, and supplies that are medically necessary and are prescribed by an authorized health care professional; and

WHEREAS, the specific requirements for diabetes coverage are covered in Hawaii Revised Statutes sections 431:10A-121, 432:1-612, and 432D-23; and

WHEREAS, S.B. No. 683, S.D. 2, H.D. 1, heard during the Regular Session of 2003, proposes to amend the statutes requiring diabetes coverage by further requiring that the diabetes education shall be provided by certain types of providers, specifically, a certified diabetes educator, a program recognized by the American Diabetes Association, or a health care professional who has completed an accredited comprehensive diabetes education review course, and provided further that when deemed medically necessary by a health care provider, the diabetes education shall be provided by only a certified diabetes educator or a program recognized by the American Diabetes Association; and

WHEREAS, the proposed amendment in S.B. No. 683, S.D. 2, H.D. 1, may add to the social and financial impacts caused by the current requirements of the statutes with regard to health insurance coverage for diabetes education; and

WHEREAS, section 23-51, Hawaii Revised Statutes, requires that, before any legislative measure that mandates health insurance coverage for certain providers of health care services can be considered, the Legislature must pass concurrent resolutions requesting the Auditor to assess both the social and financial effects of the proposed mandated coverage; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-second Legislature of the State of Hawaii, Regular Session of 2003, the Senate concurring, that the Auditor is respectfully requested to assess both the social and financial effects of the proposed mandated coverage under S.B. No. 683, S.D. 2, H.D. 1, which amends chapters 431:10A, 432:1, and 432D, Hawaii Revised Statutes, by requiring that the diabetes coverage for education be provided by a certified diabetes educator, a program recognized by the American Diabetes Association, or a health care professional who has completed an accredited comprehensive diabetes education review course, and provided further that when deemed medically necessary by a health care provider, the diabetes education shall be provided by only a certified diabetes educator or a program recognized by the American Diabetes Association; and

BE IT FURTHER RESOLVED that the Auditor is requested to submit a report of its findings and recommendations to the Legislature not later than twenty days prior to the convening of the Regular Session of 2004; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Auditor.
