HOUSE RESOLUTION

 

REQUESTING THE AUDITOR TO PERFORM A SUNRISE REVIEW OF THE registration OF PRIVATE PROCESS SERVERS AND CIVIL COURT OFFICERS.

 

 

WHEREAS, House Bill No. 979 will subject persons who serve civil process as a private process server or civil court officer to registration requirements; and

WHEREAS, persons serving as private process servers or civil court officers are currently not subject to registration requirements; and

WHEREAS, section 26H-6, Hawaii Revised Statutes, requires that new regulatory measures that would subject unregulated professions and vocations to licensing or other regulatory controls must be referred to the Auditor for analysis; and

WHEREAS, the referral must be by Concurrent Resolution that identifies the specific legislative bill to be analyzed; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-second Legislature of the State of Hawaii, Regular Session of 2003, that the Auditor is respectfully requested to analyze H.B. No.     under section 26H-6, Hawaii Revised Statutes, to set forth the probable effects of the proposed regulatory measure on private process servers and civil court officers and assess whether its enactment is consistent with the policies set forth in section 26H-2, Hawaii Revised Statutes; and

BE IT FURTHER RESOLVED that the Auditor is requested to submit findings and recommendations not later than twenty days prior to the convening of the Regular Session of 2004; and

BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Auditor.
