A BILL FOR AN ACT

 

relating to the state procurement office.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. As a member of the Western States Contracting Alliance, Hawaii is authorized to make purchases that are secondary to the state procurement office contracts through Grainger Industrial Supply. Agencies committed to a primary contract are required to purchase from primary contractors and are required to document in their procurement files why the primary contractor was unable to meet the terms of the primary contract. Inappropriate purchases made using the Grainger contract adversely impacts Hawaii businesses.

As a result, the Procurement Circular No. 2002-02, dated April 28, 2002, issued by the state procurement office to inform all chief procurement officers about procedures and requirements relating to purchases using the Grainger contract shall be deemed invalid until the state procurement office has conducted a public hearing to accept input from the public on procurement contracts to be entered into with Grainger Industrial Supply.

The state procurement office shall submit a report on the status of the public hearings, including a summary of comments received from members of the public, to the legislature at least twenty days prior to the convening of the regular session of 2004.

SECTION 2. This Act shall take effect upon its approval.
