A BILL FOR AN ACT

 

relating to public contracts.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 103D, part IX, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§103D-   Surety, bonding, and bid security technical assistance; historically underutilized businesses. The policy office shall establish a program to provide surety, bonding, and bid security technical assistance services for the benefit of historically underutilized businesses bidding or performing on a construction contract. The policy office may contract with insurance companies, surety companies, agents, or brokers to implement this program."

SECTION 2. Section 103D-901, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

""Historically underutilized business" means a small business that is a profit-making corporation, sole proprietorship, partnership, limited liability company, or joint venture in which more than fifty per cent of the shares of stock or other equitable securities are owned by one or more persons who are members of the following groups:

(1) Black American, including all persons having origins of Black racial groups of Africa;

(2) Asian Pacific American, including persons whose origins are from Japan, China, Taiwan, Korea, Vietnam, Laos, Cambodia, the Philippines, Samoa, Tonga, Kiribati, Cook Islands, or any other Pacific Island nation or territory, the U.S. Territories of the Pacific, or the Northern Marianas; and Subcontinent Asian Americans, which includes persons whose origins area from India, Pakistan, Bangladesh, Sri Lanka, Bhutan, or Nepal;

(3) Hispanic American, including all persons of Mexican, Puerto Rican, Cuban, Central or South American ancestry, or other Spanish or Portuguese culture or origin, regardless of race;

(4) Native American, including persons who are American Indians, Eskimos, Aleuts, or Hawaiians as defined in section 10-2; and

(5) Women, regardless of ethnicity."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
