Establishes duties and obligations for pharmaceutical benefit management companies who administer or manage prescription drug benefit coverage to their clients.

RELATING TO PRESCRIPTION DRUG COST CONTROL.

Establishes a prescription drug cost control education program to provide physicians with unbiased information on cost-effective use of prescription drugs; requires prescription drug manufacturers to disclose certain expenditures.

RELATING TO TELECOMMUNICATIONS RELAY SERVICES.

Authorizes the PUC to establish a surcharge to collect customer contributions for telecommunications relay services; clarifies that the PUC shall require intrastate telecommunications carriers to file a schedule or rates and charges and every provider of telecommunications relay service to maintain a separate accounting for the costs of providing telecommunications relay services for the deaf, and persons with hearing and speech disabilities.

RELATING TO PROFESSIONAL COUNSELORS.

Establishes a professional counselors licensing program, subject to the accumulation of a minimum $43,000 in a startup trust fund. Repeals the program on June 30, 2010. (HB1412 HD1)

RELATING TO EXAMINATIONS FOR THE DETERMINATION OF PERMANENT IMPAIRMENT.

Requires employer-requested medical examinations for workers' compensation cases involving the determination of permanent impairment to be performed by a physician selected by mutual agreement of the parties, or if no agreement, by a physician appointed by the director of the department of labor and industrial relations. RELATING TO THE CONTRACTORS LICENSE BOARD.

Changes the composition of the contractors license board to include 15 members, 5 each from the building trades and crafts, the contractors, and the professional engineers.

RELATING TO NONPROFIT CORPORATIONS.

Authorizes nonprofit corporations to adopt amendments to articles and bylaws to terminate, redeem, or cancel memberships. Authorizes members of nonprofit corporations to resign at any time. Authorizes nonprofit corporations to indemnify officers and directors and to advance funds for reimbursement of expenses.

Provides that a motor vehicle or trailer transaction does not constitute a sale or security interest merely because the rental price may be raised or lowered by reference to the amount realized on the sale or disposition of the motor vehicle or trailer.

Makes permanent amendments made in Act 243, SLH 2000, relating to nondiscrimination in premium rates by removing the sunset date. Amends the definition of "serious mental illness." (HB259 HD1)
