SB 1514

RELATING TO FORFEITURES.

Amends the forfeiture statutes by adding provisions similar to the Civil Asset Forfeiture Reform Act of 2000 that allows removal of cases worth less than $3500 to small claims court and adds provisions for representation by counsel, adds provisions for burden of proof, adds an "innocent owner" defense, adds provisions for the release of seized property, and liability for wrongful seizure. Conforms the notice provisions to the requirements of the U.S. Constitution, and eliminates the requirement of a bond to claim seized goods. Authorizes moneys from the criminal forfeiture revolving fund to be used for drug treatment programs.
