Requires employer-requested medical examinations for workers' compensation cases involving the determination of permanent impairment to be performed by a physician selected by mutual agreement of the parties, or if no agreement, by a physician appointed by the director of the department of labor and industrial relations. |

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Restores the method used to calculate a member's average final compensation to the formula in effect prior to the enactment of Act 128, SLH 2002. Requires the effective date of retirement to be on the first day of the month or the last day of the year for elective officers and judges who have attained the seventy-five per cent benefit limitation. Requires the ERS to pay interest on the retroactive amount due retirees whose pensions are not finalized within six calendar months following the month of retirement. Authorizes the ERS to assess an employing agency a late fee for each month of delay in reporting unused sick leave balances, lump sum vacation payments and other pertinent information (e.g., breakdown of retroactive payments) needed to finalize a retiree's pension.
