A BILL FOR AN ACT

 

relating to advanced practice registered nurses.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 431, article 13, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§431:13-   Physician and advanced practice registered nurse collaboration; discrimination prohibited. Any insurer writing policies for medical malpractice in the State shall not impose a surcharge or otherwise discriminate against any physician or surgeon licensed under chapter 453 or 460 for collaborating or entering into a collegial agreement with an advanced practice registered nurse."

SECTION 2. Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§453-   Professional collaboration with advanced practice registered nurse; no duty to supervise. A physician or surgeon licensed under this chapter shall have no duty to supervise or direct an advanced practice registered nurse with whom the physician or surgeon has collaborated or entered into a collegial agreement."

SECTION 3. Chapter 460, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§460-   Professional collaboration with advanced practice registered nurse; no duty to supervise. An osteopathic physician or surgeon licensed under this chapter shall have no duty to supervise or direct an advanced practice registered nurse with whom the osteopathic physician or surgeon has collaborated or entered into a collegial agreement."

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
