Authorizes the use of certificates of deposit issued through the Certificate of Deposit Account Registry Service to secure public funds.

Creates an exemption from the general excise tax for a management company that contracts to provide managerial and operational services to related companies that engage in the provision of medical services in order to facilitate the creation of an employee stock ownership plan.

Removes provisions that restrict telecommunications from being designated a qualified business for enterprise zone purposes.

RELATING TO ADMINISTRATIVE PROCEDURE.

Requires that every administrative rule conforms to its related statute; provides for the automatic repeal of administrative rules effective 180 days after the repeal of the related statute or ordinance; expands scope of the small business regulatory review board's annual evaluation report.

Eliminates the provision which repeals the Capital Loan Revolving fund, and maintains the moneys in the Fund for the continuance of the program.

RELATING TO THE HAWAII STRATEGIC DEVELOPMENT CORPORATION.

Repeals a section of Act 178, SLH 2003 which eliminates the Hawaii Strategic Development Corporation Revolving Fund to allow continued investment activity by the Hawaii Strategic Development Corporation.

RELATING TO BIOPROSPECTING.

Prohibits the sale or transfer of biological resources and biological diversity and establishes a temporary bioprospecting advisory commission to address issues related to bioprospecting, including equitable benefit sharing. Appropriates funds to enable the temporary bioprospecting advisory commission to develop a comprehensive plan for the bioprospecting on public lands. Provides that the commission shall cease to exist on June 30, 2007. Repeal 6/30/07.

Proposes a 20% refundable tax credit for scientific research by qualified research and development companies. Clarifies the existing investment tax credit. Extends the technology infrastructure renovation tax credit. Proposes to establish a 20% business-research institute tax credit. Creates the Hawaii Private Investment Fund Program to increase the availability of equity and debt capital for the emerging, expanding, and restructuring enterprises. Appropriates $20 million from the Hawaii Strategic Development Corporation revolving fund for the operation of Program.

Establishes safeguards to encourage corporate accountability and provides mechanisms to ensure efficient use of state funds given to corporations in the form of economic incentives.
