A BILL FOR AN ACT

 

relating to capital improvements to wells park, wailuku, maui.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the community of Wailuku, Maui has only one county park, Wells Park, which provides its youth with recreational facilities for tennis, football, baseball, and softball. Due to its close proximity to Iao Middle School, all of the school's physical education classes and sports activities are conducted at the park.

The legislature further finds that the facilities at Wells Park are deteriorating and need repairs and improvements to better serve the needs of the Wailuku community and Iao Middle School.

The purpose of this Act is to authorize the issuance of general obligation bonds to fund capital improvements to Wells Park.

SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $1,200,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2005-2006 for the purpose of repairs and capital improvements to Wells Park in Wailuku, Maui.

SECTION 3. The appropriation made for the capital improvement project authorized by this Act shall not:

(1) Be expended unless the county of Maui and private funding sources provide matching funds, on a dollar-for-dollar basis, for the sum appropriated; and

(2) Lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2008, shall lapse as of that date.

SECTION 4. The sums appropriated shall be expended by the county of Maui for the purposes of this Act.

SECTION 5. This Act shall take effect on July 1, 2005.
