A BILL FOR AN ACT

 

relating to travel agencies.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 468L, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§468L- Advertising; airfares. (a) Notwithstanding any law to the contrary, any airfare advertised by a travel agency or charter tour operator to the general public as the lowest price shall include:

(1) A valid airfare;

(2) All applicable taxes;

(3) All applicable airport fees; and

(4) All other mandatory fees.

(b) This section shall apply only to airfares for flights within the United States.

(c) This section shall not apply to airfares advertised on the Internet.

(d) Notwithstanding any law to the contrary, a travel agency or charter tour operator that violates this section shall be fined not more than $1,000 for each violation."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
