A BILL FOR AN ACT

 

relating to property damage.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 708, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§708- Enhanced sentencing for repeated criminal property damage. (a) Notwithstanding any law to the contrary, a person convicted under section 708-822 or 708-823 shall be subject to a $500 fine and community service. A person convicted under section 708-822 or 708-823, who has been previously convicted once before under either section, shall be subject to a $1,000 fine and community service.

(b) Notwithstanding any law to the contrary, a person convicted under section 708-822 or 708-823, who has been previously convicted at least twice before under either section within a period of 10 years prior to being charged for the current violation, shall be eligible to be sentenced for repeated criminal property damage under this section.

(c) Repeated criminal property damage shall be a class C felony."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
