HOUSE RESOLUTION

 

REQUESTING THE LEGISLATIVE REFERENCE BUREAU TO CONDUCT A STUDY To REVIEW HRS CHAPTER 302A AND RECOMMEND LEGISLATION TO REPEAL, AMEND, OR CLARIFY ANY STATUTES THAT HINDER THE INTENT OR IMPLEMENTATION OF ACT 51, SESSION LAWS OF HAWAII, 2004.

 

WHEREAS, the Twenty-second Legislature of the State of Hawaii, Regular Session of 2004 passed Act 51, Session Laws of Hawaii, 2004, the "Reinventing Education Act of 2004"; and

WHEREAS, Act 51 granted the Department of Education more autonomy and less dependency on other executive departments; and

WHEREAS, Act 51's goals were written to give principals more control of spending on their campuses, budgets according to individual student needs and creates school community councils to give local input into each school's academic and financial plans; and

WHEREAS, there may be statutes within chapter 302A of the Hawaii Revised Statutes that impede the spirit, goals, and implementation of Act 51; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2005, that the House of Representatives requests the Legislative Reference Bureau to conduct a study that reviews chapter 302A of the Hawaii Revised Statutes to identify any statute that hinders the intent or implementation of Act 51, Session Laws Of Hawaii, 2004; and

BE IT FURTHER RESOLVED that the Legislative Reference Bureau is requested to draft any recommended legislation; and

BE IT FURTHER RESOLVED that the legislative reference bureau is requested to submit the study and any recommended legislation, if any, to the legislature no later than twenty days prior to the opening of the Regular Session of 2006; and.

BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the legislative reference bureau, Chairperson of the Board of Education, and the Superintendent of Education.
