A BILL FOR AN ACT

 

relating to public school substitute teachers.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 302A-624, Hawaii Revised Statutes, is amended by amending subsection (e) to read as follows:

"(e) Effective [July 1, 1996,] July 1, 2005, the per diem rate or rates for substitute teachers shall be based on the annual entry step salary rate established for a Class II teacher on the most current teachers' salary schedule. The per diem rate shall be derived from the annual rate in accordance with the following formula:

Per Diem Rate = Annual Salary Rate ¸ 12 months ¸ 21

Average Working Days Per Month,

as determined by a classification and compensation plan that shall be prepared and approved by the board no later than December 31, 2005; provided that in developing the plan, the board shall consider the following classification and compensation schedule:

(1) Class I: Individuals who do not possess a bachelor's degree. The department shall hire these individuals only in geographically hard-to-fill areas, specialty areas, and other limited situations as adopted by the board;

(2) Class II: Individuals with a bachelor's degree or higher degree in a field other than education; and

(3) Class III: Retired department of education teacher or a highly qualified teacher, as defined by the No Child Left Behind Act of 2001 (Public Law 107-110), with a bachelor's or master's degree.

Individuals in Class I, Class II, and Class III, other than retired department of education teachers, shall take a substitute training course during their first year of employment and refresher courses every five years thereafter to serve in the public schools. Retired department of education teachers shall take a refresher course on the tenth year after retirement and every ten years thereafter to serve in the public schools."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2005-2006 for possible salary adjustments for public school substitute teachers beginning on July 1, 2005.

The sum appropriated shall be expended by the department of education for the purposes of this Act.

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2010.
