Requires a driver to yield the right of way to a pedestrian in a crosswalk until the pedestrian has completed crossing the road. Requires the driver to yield even if the pedestrian is on the opposite side of the road when the driver approaches, unless the pedestrian is on the opposite side of a divided roadway.

A BILL FOR AN ACT

 

RELATING TO TRAFFIC SAFETY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 291C-72, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

"(a) [When traffic-control signals are not in place or not in operation the] The driver of a vehicle shall yield the right of way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk [when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger.] and shall continue to yield the right of way until the pedestrian has completed crossing the roadway; provided that the driver need not yield the right of way to a pedestrian who is in a crosswalk on the opposite side of a roadway divided by a medial strip, divider, or other barrier."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
