A BILL FOR AN ACT

 

relating to community correctional centers.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 353-6, Hawaii Revised Statutes, is amended by amending (a) to read as follows:

"(a) There shall be a community correctional center for each county under the direction and administration of the director. Any community correctional center may be integrated and operated concurrently with any other correctional facility or facilities. Each center shall:

(1) Provide residential detention for persons who have been arraigned or have made an initial appearance and who have not been admitted to bail, released to appear, or otherwise released;

(2) Provide residential custody and correctional care for committed misdemeanants and for felons committed to indeterminate sentences;

(3) Provide for committed persons, correctional services, including but not limited to, social and psychiatric-psychological evaluation, employment, counseling, social inventory, correctional programming, medical and dental services, and sex abuse education and treatment programs for persons convicted of sexual offenses or who are otherwise in need of these programs;

(4) Provide timely detoxification services for persons who show signs of drug or alcohol abuse, including: prearraignment detainees; persons who have been arraigned or have made an initial appearance and who have not been admitted to bail, released to appear, or otherwise released; and committed persons. These services shall target the physiological and psychological symptoms of withdrawal;

[(4)] (5) Provide recreational, educational, and occupational training, and social adjustment programs for committed persons; and

[(5)] (6) Provide referrals to community educational, vocational training, employment, and work study programs; and aftercare, supervisory, and counseling services for persons released from centers."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2005-2006, and the same sum, or so much thereof as may be necessary for fiscal year 2006-2007, for establishing alcohol and substance abuse education, treatment, and support programs in community correctional centers.

SECTION 3. The sums appropriated shall be expended by the department of public safety for the purposes of this Act.

SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2005.
