A BILL FOR AN ACT

 

relating to transportation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

"§291C- School driveways; traffic control devices. Official illuminated flashing yellow signals as provided in section 291C-34 shall be placed on or about areas surrounding all driveways providing access to or from the premises of any school.

For the purposes of this section, "driveways" means every way or place used for vehicular travel that is publicly maintained, open to the use of the public, and provides ingress to and egress from a school.

§291C- Traffic-control signal; special pedestrian control signals; school zones; elderly housing. Traffic control signals, which include special pedestrian-control signals as provided in section 291C-33, shall be placed at all crosswalks on or about the streets in a school zone or surrounding housing projects for the elderly.

For the purposes of this section:

"Housing projects for the elderly" means housing projects intended for and occupied by elders or elderly households.

"School zone" means every street and all public property in the vicinity of a school as designated by the department of transportation and the counties, in their respective jurisdictions."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2006-2007 to purchase, install, and maintain official traffic-control devices, traffic-control signals, and special pedestrian-control signals as provided for in this Act.

The sum appropriated shall be expended by the department of transportation for the purposes of this Act.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2006.
