A BILL FOR AN ACT

 

relating to energy conservation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding two new sections to part I to be appropriately designated and to read as follows:

"§46- Construction of new county buildings; incorporation of Leadership in Energy and Environmental Design building standards; required. All county buildings that are planned, designed, and constructed after the effective date of this Act shall incorporate, as a part of their design, the building standards set forth in the Leadership in Energy and Environmental Design green building rating system established by the United States Green Building Council.

§46- County building permits; incorporation of Leadership in Energy and Environmental Design building standards in project design; priority processing. (a) Each county agency that issues building, construction, or development related permits shall establish a procedure for the priority processing of a permit application submitted by a private entity for a construction project that incorporates Leadership in Energy and Environmental Design building standards into its project design. The permit processing procedure shall give priority to private sector permit applicants at no additional cost to the applicant. Any priority permit processing procedure established by a county pursuant to this section shall not imply or provide that any permit application filed under the priority processing procedure shall be automatically approved.

(b) For the purposes of this section:

"Leadership in Energy and Environmental Design building standards" means the green building rating system established by the United States Green Building Council.

"Private entity" means any permit applicant that is not the State, county, federal government, or any political subdivision thereof."

SECTION 2. Chapter 196, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§196- Construction of new state buildings; incorporation of Leadership in Energy and Environmental Design building standards; required. All state buildings that are planned, designed, and constructed after the effective date of this Act shall incorporate, as a part of their design, the building standards set forth in the Leadership in Energy and Environmental Design green building rating system established by the United States Green Building Council."

SECTION 3. Section 196-28, Hawaii Revised Statutes, is amended to read as follows:

"[[]§196-28[]] Mobile equipment. (a) Each agency shall seek to improve the design, construction, and operation of its mobile equipment[,] and shall implement all life-cycle cost-effective energy efficiency measures that result in cost savings while improving mission performance. To the extent that such measures are life-cycle cost-effective, agencies shall consider enhanced use of alternative or renewable-based fuels.

(b) Each new motor vehicle purchased by an agency occurring after the effective date of this Act shall be in compliance with the federal Environmental Protection Agency's Tier 2 motor vehicle emission standards, as established under the federal Clean Air Act, as amended; provided that an agency shall not be required to comply with this section if the class of motor vehicle that an agency needs to purchase to perform its duties is not manufactured with a Tier 2 vehicle emission standard compliant emission system. By January 1, 2009, every new motor vehicle purchased by an agency shall be in full compliance with Tier 2 vehicle emission standards."

SECTION 4. (a) Each state department or agency that issues building, construction, or development related permits shall establish a procedure that provides private sector developers of construction projects that incorporate Leadership in Energy and Environmental Design building standards into its project design with priority processing of each permit application related to the Leadership in Energy and Environmental Design building standard compliant project. The permit processing procedure shall give priority to private sector permit applicants at no additional cost to the applicant. Any priority permit processing procedure established by a state department or agency pursuant to this section shall not imply or provide that any permit application filed under the priority processing procedure shall be automatically approved.

(b) For the purposes of this section:

"Leadership in Energy and Environmental Design building standards" means the green building rating system established by the United States Green Building Council.

"Private sector permit applicants" means any permit applicant that is not the State, county, federal government, or any political subdivision thereof.

(c) The governor shall submit a report to the legislature not later than twenty days prior to the convening of the 2007 regular session on the compliance by each state department or agency affected by this section.

SECTION 5. There is appropriated out of the general revenues of the State of Hawaii the sum of $ , or so much thereof as may be necessary for fiscal year 2006-2007, for the purpose of purchasing and installing solar water heating systems at state prison facilities.

The sum appropriated shall be expended by the department of public safety.

SECTION 6. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 7. This Act shall take effect on July 1, 2006.
