A BILL FOR AN ACT

 

proposing an amendment to the hawaii constitution relating to the legislature.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Article III, section 5, of the Constitution of the State of Hawaii is amended to read as follows:

"VACANCIES

Section 5. Any vacancy in the legislature shall be filled for the unexpired term in such manner as may be provided by law[, or, if no provision be made by law, by appointment by the governor for the unexpired term.]; provided that the governor shall fill a vacancy in the legislature by appointing a person from a list of not less than six nominees for the vacancy, presented to the governor by the judicial selection commission."

SECTION 2. The question to be printed on the ballot shall be as follows:

"Shall the governor be required to select a person for a legislative vacancy from a list of six nominees presented to the governor by the judicial selection commission?"

SECTION 3. Constitutional material to be repealed is bracketed and stricken. New constitutional material is underscored.

SECTION 4. This part shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
