A BILL FOR AN ACT

 

relating to vehicular emissions.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 342B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§342B- California motor vehicle emissions standards; rules. Pursuant to the Clean Air Act, the California motor vehicle emission standards in Title 13 of the California Code of Regulations, effective January 1, 2005, shall be adopted as provided in this Act and the emissions standards shall be applicable to all new passenger cars, light duty trucks, and sport utility vehicles sold in the state with a model year of 2016 or later. No later than January 1, 2008, the department shall adopt rules pursuant to chapter 91 to implement the California low emission vehicle program. The department:

(1) May implement the requirements in phases;

(2) May grant emissions reduction credits for any reductions in greenhouse gases from motor vehicles that were achieved prior to the operative date of the rules adopted pursuant to this section, to the extent permitted by state and federal law governing emissions reduction credits; provided that the 2006 motor vehicle model year shall be used as the baseline for calculating emission reduction credits;

(3) Shall provide appropriate enforcement and administrative penalties for any manufacturer or seller that violates the rules adopted pursuant to this section; and

(4) Shall amend the rules from time to time to maintain consistency with the California motor vehicle emission standards and 42 U.S.C. Sec. 7507 (section 177 of the Clean Air Act)."

SECTION 2. Section 342B-1, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

""California low emission vehicle program" means the second phase of the low emission vehicle program being implemented in the State of California, pursuant to the provisions of the Clean Air Act and the California Code of Regulations."

SECTION 3. The director of health shall submit a report to the legislature summarizing the Hawaii low emission vehicle program, including any proposed legislation necessary to implement and enforce the program no later than twenty days prior to the convening of the regular session of 2007.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
