A BILL FOR AN ACT

 

relating to denTAL SPECIALISTS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 448, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§448-   Community service license. (a) The board of dental examiners may issue without examination, to a qualified applicant, a community service license to practice dental specialties in a qualified place of employment.

(b) An applicant under this section shall submit all of the following to the board:

(1) A completed application and all required fees; and

(2) Verification:

(A) Of graduation from a general dental education program accredited by the American Dental Association Commission on Dental Accreditation or the Commission on Dental Accreditation of Canada;

(B) Of graduation from a post-graduate specialty program accredited by the American Dental Association Commission on Dental Accreditation;

(C) Of a current active license issued by another state that is not revoked, suspended, or otherwise restricted;

(D) That the applicant has been lawfully engaged in the practice of dentistry for at least three years preceding the date of the application, with a minimum of one thousand hours of dentistry practice each year; provided that the applicant may receive credit for two of the three years of clinical practice by demonstrating completion of a specialty residency training program accredited by the American Dental Association Commission on Dental Accreditation;

(E) Of completion of a minimum of thirty-two hours of continuing education in the applicant's dental specialty within the preceding two-year period;

(F) That the applicant has not been subject to disciplinary action by any jurisdiction in which the applicant is or has been previously licensed to practice dentistry; provided that if the applicant has been subject to disciplinary action, the board shall review that action to determine if it warrants refusal to issue a license to the applicant;

(G) That the applicant has no felony convictions of any kind and no other criminal convictions that may affect the applicant's ability to render competent dental care;

(H) Of registration status with the federal Drug Enforcement Administration and a self-query report from the National Practitioner Data Bank; provided that the board shall review this information to determine if it warrants refusal to issue a license to the applicant; and

(I) Of passage of parts I and II of the National Board Dental Examination.

No person who has failed to pass the dentistry licensure examination shall have the benefit of a community service license.

(c) Community service licensees shall actively participate in a formal and ongoing program of clinical quality assurance.

(d) A license may be renewed annually, pending review and reauthorization of the board of dental examiners. Renewal requests shall be submitted to the board of dental examiners sixty days prior to expiration.

(e) The community service license shall authorize the licensee to practice a dental specialty only within the employment of an eligible organization and shall be in force until the earliest of the following occurs:

(1) The date the person leaves the employment authorized under the community service license;

(2) The date on which the results of the licensure examination taken by the person under this chapter are posted by the board; or

(3) The date on which the board revokes the community service license; provided that the board may revoke the community service license at any time for cause.

(f) As used in this section:

"Dental specialties" means orthodontics, endodontics, pedodontics, periodontics, oral surgery, oral radiology, public health dentistry, or oral medicine/oral pathology.

"Qualified applicant" means any person who meets all the requirements set forth in subsection (b).

"Qualified place of employment" means a federally qualified health center, native Hawaiian health systems center, or a private practice located in geographic communities in underserved areas as defined by the Hawaii primary care association."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
