HOUSE CONCURRENT

RESOLUTION

 

REQUESTING THE DEPARTMENT OF HAWAIIAN HOME LANDS TO DEVELOP A LONG-RANGE, COMPREHENSIVE PLAN FOR THE FUTURE OF KALAUPAPA.

 

 

WHEREAS, pursuant to section 203(3) of the Hawaiian Homes Commission Act of 1920, Kalaupapa on the island of Molokai, comprising of 5,000 acres, more or less, is designated "available lands"; and

WHEREAS, pursuant to section 204 of the Hawaiian Homes Commission Act of 1920, available lands "shall immediately assume the status of Hawaiian home lands and be under the control" of the Department of Hawaiian Home Lands (DHHL); and

WHEREAS, pursuant to section 326-34, Hawaii Revised Statutes, Kalaupapa is under the jurisdiction and control of the Department of Health (DOH) and used for the care and treatment of persons affected with Hansen's disease; and

WHEREAS, within the foreseeable future, Kalaupapa will no longer be required for the care and treatment of persons affected with Hansen's disease, at which time Kalaupapa should retain its status as available lands and revert to the control of DHHL; and

WHEREAS, there is no long-range comprehensive plan relating to the future of Kalaupapa; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, the Senate concurring, that DHHL is requested to immediately begin the process of developing a long-range, comprehensive plan to set forth the overall future use of Kalaupapa; and

BE IT FURTHER RESOLVED that DHHL work in conjunction with the National Park Service, DOH, and Ka Ohana O Kalaupapa in developing a long-range, comprehensive plan for Kalaupapa; and

BE IT FURTHER RESOLVED that this long-range comprehensive plan should address the following:

(1) Goals, objectives, and policies for malama aina of Kalaupapa;

(2) Determination of the sustainable capacity for human activity at Kalaupapa;

(3) Proposed land uses, including classifications, criteria, and standards for the different types of development;

(4) Protection and management of the rich prehistoric, historic, and cultural resources of Kalaupapa;

(5) Protection and management of the flora and fauna, including avifauna and marine fauna, in and around Kalaupapa; and

(6) Protection of the aesthetics and natural beauty of Kalaupapa;

and

BE IT FURTHER RESOLVED that DHHL is requested to submit an interim report on the development of the long-range, comprehensive plan for the future of Kalaupapa to the Legislature, at least 20 days prior to the convening of the Regular Session of 2007; and

BE IT FURTHER RESOLVED that DHHL is requested to submit the completed long-range, comprehensive plan for the future of Kalaupapa to the Legislature, at least 20 days prior to the convening of the Regular Session of 2010; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Chairperson of the Hawaiian Homes Commission, Director of Health, and Director of the National Park Service.
